1. Purpose
The purpose of this policy is to ensure that all Crime Trackers Massachusetts (CTM) operations, investigations, and internal practices comply with applicable Massachusetts statutes, regulations, and legal obligations. Adherence to legal standards safeguards personnel, protects sensitive information, and maintains organizational integrity.
2. Scope
This policy applies to:
- All CTM personnel, full-time, part-time, and contract
- Operational volunteers, interns, and temporary staff
- All operational, investigative, and administrative activities conducted by CTM
3. Policy Statement
- CTM personnel must conduct all activities in compliance with Massachusetts General Laws, regulations, and local ordinances relevant to operations.
- Staff must remain informed about changes to laws affecting investigative, data handling, reporting, and operational procedures.
- Compliance with Massachusetts Public Records Law (M.G.L. c. 66, §§ 10–11) is required when responding to public information requests or handling records that may fall under public disclosure requirements.
- Unauthorized deviation from applicable laws is prohibited and may result in disciplinary action or legal liability.
4. Key Areas of Legal Compliance
A. Public Records
- Respond to requests under the Massachusetts Public Records Law in accordance with legal timelines and requirements.
- Redact or withhold information only where legally permitted (e.g., personal privacy, juvenile records, sealed investigations).
B. Investigations & Field Operations
- Ensure investigations follow applicable criminal statutes, citizen arrest laws, and trespass laws.
- All fugitive investigations and investigative activities must remain within the limits of legal authority for journalists and private investigators.
C. Data Privacy & Security
- Handle all personal, juvenile, and victim information in compliance with Massachusetts privacy laws and internal Data Privacy & Protection Policy.
- Protect information from unauthorized access, use, or disclosure.
D. Coordination with Law Enforcement
- Cooperate with law enforcement and other authorized agencies when required by law or when operating in shared investigations.
- Obtain appropriate permissions or legal authority before accessing restricted or sealed records.
5. Staff Responsibilities
- Maintain knowledge of relevant laws, regulations, and organizational policies.
- Seek guidance from supervisors or legal counsel when legal authority is uncertain.
- Report potential violations or suspected non-compliance immediately.
6. Training
- Mandatory training on Massachusetts law compliance will be provided upon onboarding.
- Refresher training will occur annually or when significant statutory or regulatory changes affect operations.
7. Oversight & Enforcement
- Supervisors are responsible for monitoring compliance within their teams.
- Non-compliance may result in disciplinary action, up to and including termination, and may involve referral to legal authorities.
- All compliance activities and corrective actions shall be documented.
8. Policy Review
- This policy will be reviewed annually or as needed to reflect updates in Massachusetts law, court rulings, or internal operational procedures.
- Updates will be communicated to all CTM personnel.
